By creating an account or using TennisEval ("the Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the Service. We may update these terms from time to time; continued use of the Service after changes are posted constitutes acceptance of the revised terms.

TennisEval is an AI-powered tennis stroke analysis platform. Users upload video clips of tennis practice sessions; the Service automatically segments individual strokes, sends contact frames to an AI vision model, and returns classified stroke parameters alongside coaching notes. The Service is intended for recreational and training purposes only.

You must provide a valid email address and verify it to activate your account. You are responsible for maintaining the confidentiality of your password and for all activity under your account. You must be at least 13 years of age to use the Service. Accounts are non-transferable. We reserve the right to suspend or terminate accounts that violate these terms.

THE STROKE ANALYSIS, PARAMETER CLASSIFICATIONS, AND COACHING NOTES PROVIDED BY TENNISEVAL ARE GENERATED ENTIRELY BY ARTIFICIAL INTELLIGENCE AND ARE INTENDED FOR INFORMATIONAL AND RECREATIONAL PURPOSES ONLY.

TennisEval's AI output is not a substitute for instruction from a qualified tennis coach or sports professional. The AI may make errors, misclassify strokes, or provide inaccurate coaching feedback. Output quality depends on video clarity, camera angle, lighting, player distance, and other factors outside our control.

You should not rely solely on TennisEval's output to make decisions about training, technique changes, or injury risk. Always consult a certified tennis coach or sports medical professional before making significant changes to your technique or training programme.

TennisEval, its directors, employees, and affiliates accept no liability for any injury, loss, or adverse outcome arising from reliance on AI-generated analysis.

When you use the Service, we collect and store the following data:

• Account data: your email address, hashed password, account creation date, and plan type. • Uploaded videos: practice clips you upload are stored in encrypted cloud storage (Amazon S3) and used solely to perform stroke analysis. • Analysis results: stroke classifications, parameters, coaching notes, and session metadata are stored in our database and associated with your account. • Usage data: timestamps of uploads, sessions viewed, and account activity for operational and security purposes.

Video files are retained for as long as your account is active. You may delete individual sessions or your entire account at any time from your profile settings, which permanently removes your videos and associated analysis data from our systems within 30 days.

We do not sell your personal data or video content to third parties. We do not use your video content to train AI models without explicit consent.

We process your personal data in accordance with applicable data protection law. By using the Service, you consent to the processing of your email address and usage data as described in Section 5 for the purpose of delivering and improving the Service.

We use Amazon Web Services (AWS) for hosting, storage, and database infrastructure. AI analysis is performed using the Anthropic Claude API. Both providers process data under their respective data processing agreements. We do not share your uploaded videos or personally identifiable information with any other third party except as required by law.

You agree not to:

• Upload video content that depicts minors without verifiable parental consent. • Upload content you do not have the right to share (e.g., copyrighted match footage without a licence). • Attempt to reverse-engineer, scrape, or access the Service's AI models or APIs by unauthorised means. • Use the Service to send spam, distribute malware, or engage in any fraudulent activity. • Attempt to circumvent usage limits, CAPTCHA, or account verification mechanisms. • Impersonate another person or create accounts on behalf of others without authorisation.

Violation of these prohibitions may result in immediate account termination and, where applicable, referral to law enforcement.

The TennisEval platform, including its software, design, branding, and AI models, is owned by TennisEval and protected by intellectual property law. You retain ownership of any video content you upload. By uploading content, you grant TennisEval a limited, non-exclusive licence to process that content for the sole purpose of providing stroke analysis to you.

The coaching notes and analysis output generated by the Service are provided to you for personal use. You may not resell, redistribute, or publish AI-generated analysis output as professional coaching advice without attribution and appropriate disclaimers.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TENNISEVAL AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF REVENUE, PERSONAL INJURY, OR PROPERTY DAMAGE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATIONS OF LIABILITY, OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

We may revise these Terms of Use at any time. We will provide reasonable notice of material changes by email or by posting a notice on the Service. Your continued use of the Service after the effective date of any changes constitutes acceptance of the new terms. If you do not agree to the revised terms, you must stop using the Service.
